These Terms of Service govern your use of TalkTime's video conferencing and branding platform. Please read these terms carefully before using our service.
1. Acceptance of Terms
By accessing or using TalkTime, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our services.
2. Service Description
TalkTime is a video conferencing platform that provides branded Microsoft Teams integration, custom branding solutions, and meeting management tools. Our services include video calling, team management, analytics, and customization features.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials, all activities under your account, providing accurate information, and compliance with these terms. You must be at least 16 years old to use our services.
4. Acceptable Use Policy
You agree not to use our services to: (a) violate any applicable laws or regulations, (b) infringe on intellectual property rights, (c) distribute malicious software or spam, (d) interfere with service operations, (e) impersonate others, (f) access unauthorized areas, or (g) use the service for any unlawful or prohibited activities.
5. Payment Terms
Subscription fees are billed monthly or annually as selected. All fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days notice. Payment processing is handled securely through Stripe.
6. Intellectual Property
TalkTime and its licensors retain all intellectual property rights in the service. You retain ownership of content you create but grant us necessary licenses to provide the service. You may not copy, modify, or distribute our proprietary technology.
7. Third-Party Services
Our service integrates with Microsoft Teams, Azure Communication Services, and other third-party platforms. Your use of these services is subject to their respective terms and conditions. We are not responsible for third-party service availability or performance.
8. Service Availability
We strive for high service availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience technical issues that temporarily affect service availability. We are not liable for service interruptions.
9. Termination
Either party may terminate this agreement at any time. You may cancel your subscription through your account settings. We may suspend or terminate accounts for violation of these terms. Upon termination, your access to the service will cease, and data may be deleted after a reasonable period.
10. Limitation of Liability
To the maximum extent permitted by Swiss law, we exclude liability for indirect, incidental, consequential, or punitive damages. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim. We do not warrant that the service will be error-free or meet your specific requirements.
11. Indemnification
You agree to indemnify and hold harmless TalkTime, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the service, violation of these terms, or infringement of any rights of another party.
12. Governing Law and Jurisdiction
These terms are governed by Swiss law. Any disputes shall be resolved in the courts of Freiburg, Switzerland. If any provision is found unenforceable, the remaining provisions shall remain in effect.
13. Modifications to Terms
We may modify these terms at any time by posting updated terms on our website. Continued use of the service after modifications constitutes acceptance of the new terms. Material changes will be communicated via email or service notifications.
